Not only does this demonstrate poor compliance with the regulations for which the HSE can prosecute, it is money that is straight out of the healthcare budget which is desperately needed elsewhere. Provided the employer has informed the employees of their duty, is exercising the appropriate level of supervision over ALL staff AND has exercised internal disciplinary proceedings to ensure compliance, employees who persistently fail to wear, look after or return their dosemeters promptly are personally liable to enforcement action by inspectors, up to and including prosecution under Section 7 of the HSW Act 1974. b) as regards any duty or requirement imposed on his employer or any other relevant statutory provisions, to co operate with him so far as is necessary to enable that duty or requirement to be performed or complied with’’ We recommend employers undertake an audit of lost badges and take action to minimise these losses. CMPE can provide a letter to share with your employees to remind them of their legal responsibilities to comply with monitoring. Recently, as group leader for Imaging Physics & Radiation Protection, I have had a number of incidents reported to me where my team are not universally granted this respect. This poor treatment arose from a range of staff, not necessarily working within imaging services. For this reason, we have developed the following text which will be added to our contract T&Cs and service specification with the purpose of offering a means of identifying and addressing issues in a timely fashion, if they arise in future. ‘’The Christie NHS Foundation Trust takes Equality, Diversity, and Inclusion very seriously. Where a Christie member of staff is working across sites (including at organisations not operated by The Christie) and has an EDI concern they will report this in the first instance to their line manager who will advise on next steps. Depending on the nature of the issue the line manager may escalate to the service manager of the facility in question, the EDI manager of The Christie NHS Trust and/or the EDI Manager of the Trust where the issue arose. Where a staff member feels they cannot raise an issue with their manager they should contact their Freedom to Speak up Guardian at The Christie who will provide advice on reporting avenues and options.
